Effective for All Bookings with Kashar Daish Tourism LLC
This Cancellation and Refund Policy (“Policy”) governs the terms under which bookings made with Kashar Daish Tourism LLC (“we,” “us,” or “our”) may be canceled and under which refunds, if any, may be issued. By making a booking with us, you (“the Client” or “you”) acknowledge and agree to the terms set forth herein.
1. Cancellation by the Client
1.1. Cancellations must be submitted in writing or via an authorized communication channel.
1.2. Bookings canceled at least twenty-four (24) hours prior to the scheduled tour commencement time shall be eligible for a refund, subject to Clause 4.
1.3. Cancellations made less than twenty-four (24) hours prior to the scheduled start time shall be non-refundable.
1.4. Failure to appear at the designated pickup point at the scheduled time shall be deemed a no-show and shall result in forfeiture of the full booking amount.
2. Payment Terms
2.1. Full payment is required to confirm any booking.
2.2. We reserve the right to cancel any unpaid or partially paid booking forty-eight (48) hours prior to the scheduled tour without further notice.
2.3. All prices are quoted in UAE Dirhams (AED), unless otherwise specified.
3. Cancellations or Modifications by Kashar Daish Tourism LLC
3.1. We reserve the right to cancel, modify, or reschedule any tour or activity at our sole discretion, with or without prior notice, due to operational requirements, insufficient participation, force majeure, governmental regulations, safety concerns, or adverse weather conditions.
3.2. In the event of such cancellation by us, you will be offered:
(a) an alternative date or service of equivalent value, or
(b) a refund of the amount paid, less a four percent (4%) transaction processing fee as specified in Clause 4.
4. Refunds and Deductions
4.1. Where a refund is approved in accordance with this Policy, it shall be processed within three (3) business days from the date of confirmation.
4.2. All refunds are subject to a non-refundable transaction fee of four percent (4%) to cover payment gateway and administrative charges.
4.3. Refunds will be made to the original payment method used at the time of booking.
5. Amendments to Bookings
5.1. Requests to modify the date, time, or nature of a booking must be received at least forty-eight (48) hours in advance of the scheduled tour time.
5.2. Modifications are subject to availability and approval.
5.3. Requests made outside the stated timeframe may be treated as cancellations and subject to Clause 1.3.
6. Force Majeure
6.1. We shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to government restrictions, natural disasters, technical failures, or extreme weather conditions.
6.2. Any refunds or compensation in such instances shall be at our sole discretion and may be subject to deductions under Clause 4.
7. Governing Law and Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
